These Terms of Service ("Terms") govern your use of SmartTrade Pro ("the App"), a Shopify application provided by SmartTrade Pro ("we", "our", or "us"). By installing or using the App, you agree to these Terms.

1. Service Description

SmartTrade Pro is a Shopify application that enables merchants to offer automatic trade and wholesale discounts to tagged customers. The App provides:

• Automatic discount application at checkout
• Customer tier management
• Per-product discount overrides
• Trade customer application and approval workflow
• Trade order tracking and analytics

2. Account and Access

To use SmartTrade Pro, you must:

• Have an active Shopify store on a paid plan
• Install the App through the Shopify App Store
• Grant the necessary permissions for the App to function

3. Subscription and Billing

SmartTrade Pro offers subscription plans billed through Shopify's billing system:

• Standard Plan: $25/month - Single global discount percentage
• Premium Plan: $49/month - Multiple tiers, per-product overrides

All plans include a 14-day free trial for new users. Subscriptions are billed monthly through your Shopify account. You may cancel at any time through your Shopify admin.

4. Refund Policy

As billing is handled through Shopify, refund requests are subject to Shopify's policies. If you experience technical issues that prevent the App from functioning, please contact us and we will work with you to resolve the issue or facilitate a refund.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to circumvent trial limitations or billing
• Reverse engineer or attempt to extract the source code
• Use the App in a way that could damage or impair Shopify's services
• Resell or redistribute the App

6. Data and Privacy

Your use of SmartTrade Pro is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described therein.

7. Intellectual Property

SmartTrade Pro and all associated trademarks, logos, and content are the property of SmartTrade Pro. You are granted a limited, non-exclusive license to use the App for your Shopify store while your subscription is active.

8. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• The App will meet your specific requirements
• Any errors will be corrected

9. Limitation of Liability

To the maximum extent permitted by law, SmartTrade Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the App.

10. Indemnification

You agree to indemnify and hold harmless SmartTrade Pro from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue the App at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
